TERMS OF SALE
By placing an order you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price. Dispatch times may vary according to availability and subject to any delays resulting from postal delays or force majeure for which we will not be responsible. In order to contract with FRESHEMP™ you must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us. You may pay by any method that is listed on our website. We are under no obligation to accept your order.
FRESHEMP™ retains the right to refuse any request made by you. If your order is accepted we will inform you by email. When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorized user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods. The cost of foreign products and services may fluctuate. All prices advertised are subject to such changes.
OUR CONTRACT
When you place an order, you will receive an acknowledgement email confirming receipt of your order: this email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us will not be formed until we send you confirmation by email that the goods which you ordered have been dispatched to you. Only those goods listed in the confirmation email sent at the time of dispatch will be included in the contract formed.
PRICING AND SHIPPING COSTS
All prices are clearly displayed on the web site and will be confirmed at the checkout prior to payment.
Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled and give you a full refund. Delivery costs may be charged in addition; such additional charges are clearly displayed where applicable and included in the "Total Cost". No shipping costs will be charged for destinations inside the E.U. For E.U. orders, the shipping of the replacement jacket will also be free of charge.
After this, if you would like to return the replacement jacket as well, the return costs will be paid by you. For outside E.U. orders,
OUTSIDE E.U. SHIPMENTS
FRESHEMP™ Originals offers shipping to the following destinations outside the E.U.: Switzerland, Norway, U.K and U.S.A. Shipping and handling costs will be charged for these destinations. Please note that you will be charged local VAT (sales tax) and import duties when importing to these countries. If you would like to return a jacket that was sent to one of these destinations, you will have to pay return shipping costs. You will be responsible for claiming back the V.A.T. and import duties that were paid upon import and FRESHEMP™ carries no responsibility for this, nor can FRESHEMP™ be held responsible for any financial damages incurred by outside E.U. customers who, for any reason, are unable to claim back V.A.T. and import duties for a returned jacket. Please contact us through our chat, contact form or send us an email at info@freshemp.eu if you would like to return a jacket that was sent to an outside E.U. destination, in order for us to instruct you about the return procedure.
PAYMENT
Upon receiving your order we carry out a standard authorization check on your payment card to ensure there are sufficient funds to fulfil the transaction. Your card will be debited upon authorisation being received. The monies received upon the debiting of your card shall be treated as a deposit against the value of the goods you wish to purchase. Once the goods have been despatched and you have been sent a confirmation email the monies paid as a deposit shall be used as consideration for the value of goods you have purchased as listed in the confirmation email.
SHIPPING TIMES
Your FRESHEMP™ Originals order will be shipped the next working day after the day you made the order. It will be shipped with DHL. Shipping time will be a maximum of 2-3 working days for most E.U. destinations and 3-5 working days for more remote countries. After your order has been shipped you will receive a DHL tracking number to track your order.
ACCURACY OF INFORMATION
We try to make sure that the information on this website is current, complete and accurate.
However, despite our efforts, occasionally the information on this site may be inaccurate, out of date or incomplete. For instance products on this website may be unavailable or have different characteristics than those listed or may be priced differently than listed on the website. Additionally we alter information about price and availability without notice. If by mistake we have underpriced an item we will not be liable to supply that item to you at the incorrect stated price, provided that we contact you before we ship the item to you. If this would take place, we will inform you about the correct price in order for you to decide if you wish to order the item at that price. If you choose not to order the item at that price we will issue a full refund.
LIMITS ON LIABILITY
Except in cases where prevented by law, in no case will any liability that we might incur to the customer exceed the greater of Euro 500.- or the total amount paid by you for the products that you have purchased relating to any possible claim you would potentially make. In no circumstances shall we be liable for any consequential loss, including any loss of revenue or profit. No information which is stated in these terms and conditions shall affect your legal rights.
